These Terms of Service (“Terms”) constitute a binding legal agreement between BEYOND (“the Platform,” “we,” “our,” or “us”) and any individual, business, or entity accessing or using the Platform (“User,” “you,” or “your”). By creating an account, accessing, or using any feature of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any policies incorporated herein by reference, including without limitation the Responsible Vendor Policy, Appropriate Exposure Policy, and User Data Purge Policy.
If you do not agree, you must not use the Platform.

1. Eligibility and Registration
1.1 You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. Users under the age of 18 may only access the Platform with verified parental or guardian consent where legally permitted.
1.2 All registration information provided must be truthful, accurate, and kept up to date.
1.3 Each User may maintain only one individual account unless expressly permitted by BEYOND for business purposes.
1.4 You are solely responsible for maintaining the confidentiality of your account credentials and any wallet keys associated with your use of the Platform.

2. Membership Levels
2.1 BEYOND may offer different membership levels, both free and paid. The features available to you may depend on your membership level.
2.2 Membership benefits are personal to you and may not be transferred or assigned without BEYOND’s written consent.
2.3 BEYOND reserves the right to modify, limit, or revoke membership benefits at any time, in its sole discretion.

3. User Responsibilities
3.1 You agree to use the Platform only in compliance with applicable laws and regulations.
3.2 You agree not to engage in fraud, harassment, discriminatory conduct, or abusive behavior toward other Users.
3.3 You agree to comply with all Platform policies, including the Responsible Vendor Policy, Appropriate Exposure Policy, and User Data Purge Policy.

4. Platform Services
4.1 Crowdfunding and Donations
• Users may create or donate to crowdfunding campaigns.
• Campaign creators are solely responsible for delivering any promised rewards.
• BEYOND processes payments, deducts applicable fees, and disburses payouts only once minimum thresholds are met.
• BEYOND disclaims liability for unfulfilled rewards but reserves the right to investigate and enforce against fraud.
4.2 Events
• Users may host or attend events on the Platform. Hosts may charge ticket fees.
• Payment processing and payout procedures follow the same structure as crowdfunding.
• BEYOND is not responsible for event quality, safety, or compliance with local laws.
4.3 Shops/Stores
• Users may open storefronts to sell goods or services, subject to the Responsible Vendor Policy.
• BEYOND is not liable for third-party vendor fulfillment or misrepresentation.
• BEYOND may investigate fraud, suspend vendor accounts, and refund untransferred amounts to buyers.
4.4 Contests
• Users may host contests, including paid-entry contests. Hosts are solely responsible for awarding prizes.
• BEYOND will fulfill prizes only for contests hosted directly by the Platform.
4.5 Groups
• Users may create public, semi-private, or private groups.
• Adult content is permitted only in compliance with the Appropriate Exposure Policy.
• Group creators are responsible for their group’s moderation.
4.6 Credits
• Credits may be earned based on membership level or actions within the Platform.
• Credits are not legal tender and may not be exchanged outside the Platform.
• Cash credits may be redeemed subject to membership level, payout thresholds, and applicable deductions.
4.7 Petitions
• Petition creators are solely responsible for identifying decision-makers and promoting petitions.
• BEYOND provides only the technological tools and does not guarantee legal or political outcomes.
4.8 Verifications
• Verification indicates only that BEYOND has conducted a preliminary investigation.
• Verification does not constitute a warranty or guarantee of authenticity.
• BEYOND may revoke verification status at its discretion.
4.9 Moderation and Content Control
• Users are responsible for marking adult or sensitive content in compliance with the Appropriate Exposure Policy.
• Content flagged by Users will be reviewed by BEYOND staff.
• Users retain ownership of their content, but grant BEYOND a license to host and display it on the Platform.
• Content and account deletion may be restricted at certain membership levels to prevent fraud or manipulation.
4.10 Account Deletion
• BEYOND may restrict account deletion in order to preserve integrity of petitions, public sentiment votes, or other records.
• Accounts inactive for three (3) years will be automatically deleted.
• Users may request voluntary deletion subject to applicable restrictions.
4.11 Booking/Services
• Users may offer professional services through the Platform, provided such services are lawful under Canadian law.
• BEYOND disclaims liability for service quality or delivery.
4.12 Business Listings
• Users may add business or service listings.
• Validation of listings may occur through user engagement or moderation.
• BEYOND disclaims liability for third-party businesses.
4.13 Jobs
• Job postings remain valid for a maximum of three (3) months.
• BEYOND disclaims liability for accuracy of resumes or job applications.
4.14 Articles
• Only Users at certain membership levels may publish articles.
• Articles with a verification badge indicate fact-checking but do not guarantee accuracy.
• BEYOND reserves the right to remove false or misleading articles.
4.15 BEYOND Token
• The BEYOND Token is a reward token, not an investment or security.
• Tokens may be distributed through airdrops, liquidity pools, or other rewards.
• Tokens have no guaranteed monetary value and may not be redeemed for cash.
• KYC verification is required for participation in token airdrops.

5. Payments and Fees
5.1 BEYOND deducts platform fees from all transactions, in amounts that may vary by membership level.
5.2 Payouts are subject to minimum thresholds and may be delayed for fraud investigation.
5.3 Refunds and chargebacks are governed by BEYOND’s discretion and applicable law.

6. Intellectual Property
6.1 Users retain ownership of all content uploaded.
6.2 By posting content, Users grant BEYOND a non-exclusive, worldwide license to host, display, and distribute content for Platform functionality.
6.3 Users may not use BEYOND’s name, logo, or branding without written consent.

7. Privacy and Data Protection
7.1 Use of the Platform is subject to BEYOND’s Privacy Policy, incorporated herein by reference.
7.2 BEYOND may collect, process, and disclose data consistent with the Privacy Policy.
7.3 User data may be purged in accordance with the User Data Purge Policy.

8. Prohibited Activities
• Use of the Platform for unlawful purposes.
• Circumventing fees or payout systems.
• Sale of illegal or prohibited goods.
• Harassment, exploitation, or hate-based conduct.
• Interference with Platform operations or security.

9. Termination and Suspension
9.1 BEYOND may suspend or terminate User accounts for violations of these Terms.
9.2 Users may terminate their account voluntarily, subject to Section 4.10.
9.3 Termination does not relieve Users of obligations arising prior to termination.

10. Disclaimers and Limitation of Liability
10.1 The Platform is provided “as is” and “as available.”
10.2 BEYOND disclaims all warranties, express or implied, including merchantability or fitness for a particular purpose.
10.3 BEYOND shall not be liable for indirect, incidental, or consequential damages arising from use of the Platform.

11. Indemnification
Users agree to indemnify and hold BEYOND harmless from any claims, damages, or liabilities arising from their content, conduct, or services.

12. Governing Law and Dispute Resolution
12.1 These Terms shall be governed by the laws of Ontario, Canada.
12.2 Any dispute shall be resolved through binding arbitration or mediation in Ontario, unless otherwise required by law.

13. Amendments
BEYOND may update these Terms from time to time. Notice will be provided via email or site notice. Continued use constitutes acceptance of changes.

14. Miscellaneous
• Severability: If any provision is invalid, the remainder remains enforceable.
• Entire Agreement: These Terms, together with incorporated policies, form the complete agreement.
• Waiver: No failure to enforce constitutes a waiver of rights.
• Assignment: Users may not assign rights without BEYOND’s consent.
